Defense Legislation Status:

NDAA

On September 23, 2021, the House of Representatives passed their version of the NDAA. To date, the Senate has not completed their version of the NDAA. Until the Senate completes their version of this legislation, there is no ability to create a standardized version of the NDAA that can be brought before both chambers of congress for final approval.

It appears that is it unlikely that the FY 2022 NDAA will be completed before the end of 2021. This would be the first time in over 60 years that Congress would not be able to complete and approve the NDAA in a calendar year.  However, even without an approved FY 2022 NDAA, DoD can continue to operate using only the authorizations approved in the previous year’s NDAA. This may seem a bit odd, but it is important to understand that DoD utilizes a Fiscal Year Calendar from October 1 through 30 September of the following year which means that DoD is already operating in FY 2022 and has been using the FY 2021 NDAA as guidance.

At this time, it seems more likely that the FY 2022 NDAA would be approved sometime in early 2022.

Appropriations

Neither the House of Representatives nor the Senate have completed their versions of the Appropriations Bill.  This is not surprising since typically the Appropriations bill is passed once the NDAA is approved.  The reason for this is that the NDAA is used to identify and authorize manpower limits, programs, and make changes to policies and organizations of DoD.  Once completed, Congress must apply the appropriate funding levels to support those authorizations through appropriations.

Knowing that they were not going to be able to pass a full Appropriations Bill, on September 30, 2021, Congress passed a short-term Continuing Resolution (CR) that continued to fund government agencies to include DoD through December 3, 2021.  On Thursday, December 2, 2021, Congress averted a potential government shutdown by passing and additional CR that will continue to fund the government until February 18, 2022. If Congress fails to pass the Appropriations Bill or does not pass a third CR by February 18th, the lack of approved government funding would trigger a partial government shutdown which would have a significant impact on the National Guard.

Unfortunately, no one has a crystal ball and can say for certain what will happen with the FY 2022 NDAA or the Appropriations Bill.  What we do know is that Congress continues to struggle to find common ground and pass Defense legislation in a timely manner.

EANGUS continues to communicate to Congress about the importance of these pieces of Legislation and how their inability to pass them has an adverse effect on the National Guard Community.
